Ratification of International Labor Organization (ILO) Convention No. 87 in June 1998 lead to radical changing labor policies of the Indonesian government. Uunder the guidance of ILO it issued the Union Law No. 21/2000, which was one of the first major laws that were accepted during the reformasi. This law permitted workers to establish labor unions at the enterprise level. The establishment of this law quickly led to an enormous rise of enterprise unions, which at a higher level were organized in labor union federations. Unfortunately, the rising power of labor has wrongly been understood by many.

This unique and practical workshop is designed for people wishing to get the knowledge and to learn the most effective way negotiating with unions in Indonesia from beginning to end.  It focuses on key concepts and processes that enhance skills, knowledge and tools to deliver the best and least disruptive bargaining outcome.

Course Outline


This 1 day workshop aim to address the following:

  1. Discover the hidden opportunities embedded in the Indonesia Employment  Act
  2. A detailed insight into the tactics used by unions during negotiations and how best to respond
  3. How to practically make bargaining work for you
  4. A clear understanding of the ritual of collective negotiations and how you can use this to gain advantage
  5. New and updated techniques for building stronger relationships to reduce the IR heat in your workplace
  6. The confidence and ability to quickly and firmly deal with difficult negotiators or unacceptable behavior

  2. Legal requirements, process and procedures
  3. Know your legal options during negotiations
  4. Protected and unprotected industrial action
  5. Detailed overview of the ritual followed by unions when negotiating with employers
  6. Understanding the interaction of external influences on the bargaining process
  7. The collective psychology vs the role of the individual
  8. Why the positional & adversarial negotiating model is still the most commonly used.  What other options exist?
  9. Preparation & planning and how management differs substantially with  unions
  10. Who are the key players and what essential attributes are required to be successful
  11. A realistic and practical risk assessment process before starting negotiations
  12. Selecting the winning team
  13. Communications strategy and tactics both internally and externally – who is responsible for what
  14. Where to open and when to make concessions
  15. An in-depth analysis of the unique communications process when in negotiations

A practical and very realistic simulation which allows you as part of a group to test and experiment with the new techniques and methods learnt. Both groups are guided by a negotiations coach throughout in a relaxed, friendly, no-stress environment.

Workshop Leader

Hendri Gemilang is an expert in Indonesian Employment Law. A former Consultant of the reputed PT Tunaskarya Indonesia, Hendri was also senior executive in human resource consultancy attached to a company located in Batam, Indonesia. His past experience includes over 20 years of HR & IR experience. He boasts of experience as corporate secretary for PT Yeakin Plastic Indonesia and HR Manager of a Garment factory, PT Polly Allied, Indonesia. Hendri is also The President Director of PT HS Gemilang, a mechanical engineering specialist organisation. A writer and mentor of “Attitude workouts and attitude revolution”, Hendri has penned his experience in Industrial relations and disputes in Indonesia. Hendri graduated from the University of Andalas. West Sumatera, and majors in English language and literature.
